Effective July 30, 2026. These terms are an agreement between you and SaySpark(“SaySpark”, “we”) covering the SaySpark website, apps, simulator, cloud services, and early-access program (together, the “Service”). By creating an account or using the Service you agree to them. Our Privacy Policy explains how we handle data and is part of these terms.
SaySpark is pre-release software under active development. Features may change, break, or be removed; simulated progress, scenes, and content may be reset; and the Service may be unavailable at times. Free access during early access is a courtesy, not a commitment to any future price, feature, or availability. The Spark Mini robot is separate hardware that is not part of the Service today; hardware purchases at launch will have their own terms.
Accounts must be created by an adult (a parent, guardian, teacher, or school administrator). Children use SaySpark under that adult's supervision and consent, as described in the Privacy Policy. You are responsible for keeping your credentials secure and for activity under your account, and you agree to give us accurate information.
Spark is an AI system. It can be wrong, incomplete, or unexpected, and its responses are generated automatically — they are not reviewed by a person and are not professional, educational-assessment, or safety advice. An adult should supervise children's use. Where the tutor controls a robot or simulator, you are responsible for using it in a safe environment.
You agree not to: misuse or attempt to circumvent usage limits (including the free demo's limits); probe, disrupt, or overload the Service; attempt to extract other users' data; use the Service to generate unlawful, harmful, or infringing content; or resell the Service without our written permission. We may suspend or terminate access that violates these terms or harms the Service or its users.
You keep ownership of the content you create (scenes, programs, messages). You give us the limited license needed to operate the Service — to store, process, transmit, and display that content back to you and the people you share it with. The SaySpark software, models' outputs presentation, branding, and website are our intellectual property or that of our licensors; these terms don't transfer any of it to you.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, SaySpark will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service. Our total liability for any claim is limited to the greater of the amounts you paid us for the Service in the 12 months before the claim and CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You can stop using the Service and delete your account at any time (see the account page or contact us). We may suspend or terminate the Service or your access for violation of these terms, legal reasons, or discontinuation of the early-access program; where practical we'll give notice. Sections that by their nature should survive (IP, disclaimers, liability limits) survive termination.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, and disputes will be resolved in the courts located in Ontario, Canada, unless the law where you live requires otherwise.
We may update these terms as the product evolves. We'll post the new version here and update the effective date; material changes will be communicated to account owners. Continuing to use the Service after a change means you accept the updated terms.
